This website is controlled and operated by The British Tomato Growers’ Association. We take your privacy very seriously so this policy sets out the ways in which we may collect personal data, why we do that and your rights to the way we store this data.

Data protection

The British Tomato Growers’ Association is committed to protecting the privacy and confidentiality of your private information. We uphold the relevant data protection principles and process data in accordance with the Data Protection Act 2018 (DPA 2018) and the General Data Protection Regulation (GDPR) which requires organisations that process personal data to meet certain legal obligations.

The British Tomato Growers’ Association enters into a contract with data subjects and process data on that basis, information is collected for the purpose of:

  • Administering a relationship with the data subject, providing services and responding to enquiries and retaining information related to current client service provision

  • Enabling business development through the retention of data held under legitimate interest

  • Enabling The British Tomato Growers’ Association to meet legal and other regulatory obligations

The information collected is known as ‘personal data’ and can include (but is not limited to) name, address, email address, telephone and other contact numbers and financial information. The information is collected in several different ways. For example, data may be provided directly online or over the telephone, or when corresponding by letter. This data is then retained for legitimate purposes under the relevant legislation and disposed of once services or relationships have ceased.

The British Tomato Growers’ Association retains records based on a retention policy so that it can defend against potential legal claims or disciplinary action which can be brought within statutory time limits. On occasions, The British Tomato Growers’ Association may process information outside of the UK but will maintain written records of processing activities performed which shall include: (i) the categories of processing activities performed; (ii) details of any on cross border data transfers outside of the European Economic Area (EEA); and (iii) a general description of security measures implemented in respect of the client personal data.

If personal data is transferred to a country or territory outside the EEA it will do so in accordance with data protection legislation.

If the law allows or requires personal information during the period of contractual arrangements or after The British Tomato Growers’ Association has ceased to act information may be given to:

  • The police and law enforcement agencies

  • Courts and tribunals

  • The Information Commissioner’s Office (ICO)

In addition, after The British Tomato Growers’ Association has ceased to act information may be given to:

  • Professional indemnity insurers or legal advisers where we need to defend against a claim

  • Professional disciplinary body where a complaint has been made, in order to defend the company against a claim

  • The data subject’s new advisers or other third parties they ask us to give information to

The data subject can request to have their personal information removed at any time or can request to see records or any other information the organisation holds about them – this must be requested in writing.

Use of your information 

Your information will enable us to provide you with access to all parts of our website, to administer accounts and/or orders and to provide you with other services and information. It will also enable us to process and complete orders, to process payments and/or to bill you and to contact you, where necessary.

In particular, we may use your information to contact you for your views on our services and to notify you occasionally about important changes or developments to them or to the website. Where you have consented to us doing so, we might also use your information to let you know about other services which we offer which may be of interest to you including forthcoming events and we may contact you by post, telephone or email. If you no longer wish for us to contact you, please let us know. Users have the right to ask us to stop processing their personal data for direct marketing purposes at any time.

We do not partner with or have special relationships with any ad server companies.

Data privacy is important to us. We will never sell your data to any third party, and usage of any data is strictly for business purposes only.

Disclosure of your information 

The information you provide to us will be held on our computers in the UK and may be accessed by or given to our staff and third parties within, and occasionally, (where necessary to fulfil and deliver orders) outside of, the EEA. Those parties process information, fulfil and deliver orders, process credit or debit card payments and provide support services on our behalf. We may also pass aggregate information on the usage of our site to third parties, but this will not include information that can be used to identify you.

To help us make credit decisions about you, to prevent fraud, to check your identity and to prevent money laundering, we may search the files of credit reference agencies who will record any credit searches on your file and/or those of your principal directors/shareholders where relevant. We may also disclose details of how you conduct your account to such agencies. This information will be used by other credit grantors for making credit decisions about you and the people with whom you are financially associated, for fraud protection, money laundering prevention and occasionally for tracing debtors.

We employ security measures to protect your information from access by unauthorised persons and against unlawful processing, accidental loss, destruction and damage. We will retain your information for a reasonable period or as long as the law requires. Countries outside of the EEA do not always have strong data protection laws. However, we will always take steps to ensure that your information is used by third parties in accordance with this policy statement.
